According to Reuters, WASHINGTON: This Thursday, former US President Trump said he was not guilty of new criminal charges in a federal lawsuit. According to the charges he tried to change, he lost the 2020 presidential race.
During a court hearing in Washington, D.C., Trump’s lawyers made the “not guilty” plea. After the US Supreme Court said that past presidents are generally immune from criminal punishment, the meeting was mostly about how the case should move forward. Trump, who is running for president as a Republican on November 5, did not show up to the session.
When the new accusation came out in August, it had the same four charges as the old one, but it left out some claims that the Supreme Court thought were wrong. The first person to bring these charges was Special Counsel Jack Smith. Judge Tanya Chutkan of the US District Court is now looking at both sides’ plans. Smith wants to move the case along quickly, but Trump wants to wait until after the election to do anything. Judge Chutkan was told by the Supreme Court to decide if more parts of the case should be thrown out.
Four criminal charges have been brought against Trump for allegedly using fake claims of voting fraud to try to change the election results. Authorities say he tried to stop the official announcement that he had lost to President Joe Biden. Because Trump wants protection, the case has been put off for months. Because of this, it won’t go to trial before the election, when Trump is likely to run against Vice President Kamala Harris.
Trump says that the charges against him and other court cases are politically driven attempts to hurt his campaign for president. With a vote of 6-3, the Supreme Court said in July that past presidents usually can’t be charged with a crime for things they did while they were in office. Smith, however, says that this protection does not cover the other charges and that they should go to trial. Prosecutors are ready to make their case whenever the court thinks it’s proper.
The lawyers for Trump say that Judge Churkin should think about the decision on immunity in December, after the election. It is believed that if Trump wins, he will tell the Justice Department to drop the charges. His lawyers are going to challenge the case by saying that Smith was named as special counsel without the right paperwork. Trump in Florida used a similar argument to get a federal judge he had chosen to throw out a different case that accused him of illegally keeping secret papers after leaving office. Smith’s office is going to argue that choice.
